Welcome to the Skuisito.com site (hereinafter the Site).
The following conditions apply to each purchase of Products through the Site.
We invite you to carefully read these General Conditions of Sale before proceeding with any purchase. By making any purchase, you fully accept these General Conditions of Sale.
ART. 1 - DEFINITIONS
1.1. "Site" is the website skuisito.com, dedicated to the sale of typical Sicilian products made by artisan companies.
1.2. "Customer" is the subject (natural or legal person) who makes the purchase on the Site.
1.3. "Skuisito" is Skuisito, with registered office in via Alcide de Gasperi 10 - 93010 Serradifalco (CL) - C.F. - VAT no. 00000000000000.
1.4. "Order" is the request form for goods for sale, filled in by the Customer through the Site.
1.5. "Products" are the goods offered for sale on the Site, based on the general conditions of sale.
1.6. "Contract" is the distance contract that has as its object the sale of the Products, based on these general conditions of sale.
1.7. "Parties" are Skuisito and the Customer.
ART. 2 - INFORMATION FOR THE CONCLUSION OF THE CONTRACT
2.1. In order to make a purchase through the Site, you must be over 18 years of age. It is the Customer's responsibility to ensure that the information provided at the time of the request or order is true, accurate and complete. Skuisito will not be held responsible for orders placed by minors without the permission of their parents.
2.2. With reference to the various technical steps to be followed for the conclusion of the Contract on the Site, it is possible to follow a guided procedure that at any time allows the Customer to verify and then validate any information entered and to correct errors before placing the Order up to the conclusion of the Contract. The various technical steps for placing the Order are summarized as follows:
I. select the Product and press the "add to cart" button: at that point, the summary of the main characteristics of the chosen Product and the indication of the total price due, including shipping costs, will appear (with the exception of any customs duties, where due) and taxes. If you want to purchase multiple Products, you can select them one at a time, adding them to the cart. As long as the cart is not closed and the Order is not submitted, it is always possible to delete or add new Products to the cart;
II. once all the items have been selected, to close the cart and submit the Order, press the "proceed to purchase" button. It will be possible to proceed with the purchase by logging in with your data, if you have already registered on the website www.skuisito.com. The Customer will then be asked to enter the delivery address and to indicate if it is a company and, if so, if they want an invoice. Once the Customer has entered the shipping address, a summary page of the Order will appear with an indication of the Products chosen, their price and shipping costs. The Customer, before proceeding to the next step, is required to verify the accuracy of the data entered, for whose veracity he is responsible. At this point the Customer will be asked to select the preferred payment method;
III. before proceeding with the purchase, the Customer must read the general conditions of sale by pressing the relevant button and express acceptance of them by clicking on the box next to the words "I declare that I have read and accept the general conditions of sale";
IV. finally, the customer must press the "buy" button. The purchase order implies the obligation to pay and the forwarding of this order is therefore equivalent to the simultaneous authorization by the Customer to withdraw the sums provided for in the contract.
2.4. The order will therefore be considered as a binding contractual purchase proposal addressed to Skuisito for the listed Products, considered individually. Upon placing the Order, the Customer will receive an automatic response message of taking charge of the order itself ("Order Confirmation") which will indicate the type of Products ordered, the price of each of them inclusive of VAT, the delivery costs, the chosen payment method, the delivery terms as well as the information relating to the Customer Service Contacts and the existence of the right of withdrawal referred to in the following art. 8, exercisable under the relevant conditions. Therefore when placing your order it is important to make sure you have entered a valid email address.
2.5. An order completed and therefore forwarded can no longer be modified, i.e. other Products can no longer be added, deleted, or modified. Likewise, it is not possible to replace the Products. In such cases it must be effet Once a new Order has been entered, the right of withdrawal under the terms and conditions set out in the following art. 8.
2.6. The Order Confirmation does not constitute acceptance of the purchase proposal. By sending the Order Confirmation, in fact, we only confirm that we have received the order and have subjected it to the data verification process and availability of the requested Products. The acceptance of the order and the formulation of the product sales contract between Skuisito and the Customer will not actually take place until the Customer has received from Skuisito an email confirming the shipment of the Products from its warehouse, which will contain, in addition to the particular conditions indicated above (the Products requested, the price, the applicable taxes, the means of payment used, the delivery costs and the conditions of withdrawal) and these General Conditions of Sale, also the information relating to the shipment of the Product (" Shipping Confirmation "), with the right for the Customer to have access to them by downloading and printing or archiving the email and the General Conditions of Sale on their computer.
Here are some examples of circumstances in which an Order may not be accepted:
(a) The Products, although shown on the Site, are not available;
(b) We are unable to obtain the Customer's payment authorization;
(c) A Product is subject to certain shipping limits;
(d) A Product displayed on the Site contains an obvious error, for example an incorrect price or an otherwise incorrect description.
If one or more Products ordered by the Customer are no longer available, it will not be possible to accept the Order for the unavailable Products. In this case we will immediately inform the Customer by email and the Order will remain valid and the contract will be concluded limited to the Products actually shipped and the Customer will not be able to refuse partial delivery or payment of the goods actually delivered, nor will he be entitled to obtain compensation. o indemnities, but only to receive the refund of the price corresponding to the unavailable Product (s), if already paid, it being understood that the right of withdrawal is in any case without prejudice to the terms and conditions referred to in the following art. 8.
2.7. With reference to the way in which the contract, once concluded, will be filed and the relative access methods by the Customer, the Order will be filed by Skuisito in its database for the time necessary for the execution of the same and, in any case, in the terms of law. The Customer will always have access to the text of these General Conditions.
2.8. The languages available to customers for the conclusion of the contract are Italian and English. In any case, in the event of a conflict between the provisions of these General Conditions of Sale, as published in Italian, and the corresponding text published in English, as well as in the event of a conflict with the Italian version and the English version of any other information and / or content of the contract, the Italian version must be considered prevalent.
2.9. The graphic representation of the Products is made for the sole purpose of illustrating the Product and is purely indicative. Color and other minor variations are possible in the Products due to the use of different technologies for the acquisition and reproduction of images. Skuisito is not responsible for such variations and deviations.

ART. 4 - REGISTRATION
4.1. To make the purchase of the Products it is not necessary to make a prior registration. The Customer can still choose to register on the website www.skuisito.com; registration is free, fast and does not involve any obligation to purchase. To register and create the relevant account, the Customer must fill in the appropriate online form on the website www.skuisito.com, entering their personal data requested therein, as well as an e-mail address and a password, accept the terms and conditions of use of the website www.skuisito.com and read the privacy policy. It is absolutely and strictly forbidden to enter, for the purposes of registration, personal data of third parties, false, invented, fictional and / or, in any way, not true to the truth.
4.2. Each customer can take advantage of only one registration on the website www.skuisito.com. It is therefore absolutely and strictly forbidden for the user to create multiple accounts referable to the same person, natural and / or legal, and / or to companies and / or entities of any kind, including through the use of data corresponding to the truth. In case of violation of this prohibition, Skuisito reserves the right to close all accounts referable to the same person, natural and / or legal. The Customer also undertakes to keep Skuisito harmless and harmless from any damage or obligation compensation and / or sanction deriving from and / or in any way connected to the violation by the Customer of the prohibition referred to in this article 4.2.
4.3. Registering on the site allows the Customer to carry out, among other things, the following activities through the confidential and personal account: - manage their personal data and modify them at any time; - change your password; - take advantage of the dedicated services that can be activated from time to time by Skuisito.
4.4. The registration credentials (e-mail address and password) allow the Customer to make purchases on the Site and to carry out, among others, the activities referred to in art. 4.3 above. They must, therefore, be stored with extreme care and attention. Furthermore, they can only be used by the Customer and cannot be transferred to third parties. The Customer undertakes to keep them secret and to ensure that no third parties have access to them. He also undertakes to immediately inform Skuisito in the event that he suspects or becomes aware of an improper use or undue disclosure of the same.
4.5 The Customer guarantees that the personal data provided to Skuisito during the registration procedure, or at any other time and / or occasion of his relationship with Skuisito, are complete, truthful and referred to the Customer himself and undertakes to keep Skuisito harmless and indemnified. from any damage, compensation obligation and / or sanction deriving from and / or in any way connected to the violation by the Customer of the guarantee referred to in this article and / or to the violation of the rules on registration on the site and / or on the conservation of credentials of registration. 4.6.
ART. 5 - PRICE, PAYMENT AND INVOICE
5.1. The prices are expressed in Euros (€) and include the Value Added Tax (VAT) in force for the respective product categories to which they belong. Price changes are possible and in this case the Site will be updated with the indication of the new price. The amount will be charged in Euros. Conversion into other currencies is purely indicative.
5.2. The total price resulting at the end of the order includes shipping costs which vary according to the country of destination (the Customer can view the cost online at the end of the Order before confirming it), but not any customs duties and / or additional sales taxes, necessary for importing the goods into foreign territory.
5.3 In case of shipment addressed to a country outside the European Union, the goods may be subject to the imposition of customs duties and any sales taxes. Any additional charges relating to customs clearance will be borne exclusively by the recipient. In case of refusal of the goods by the Customer or non-delivery for other reasons (e.g. incorrect address and / or telephone number of the recipient; repeated absence of the recipient, etc.) the recipient will be charged and withheld from the refund of the price of the goods from the Customer, the amount to cover the following expenses: "goods forwarding" + "goods return" + "customs for return". Customs duties and any taxes vary according to the country of destination and are applied upon arrival of the goods in the same country. For information relating to the amount of duties and any taxes, and the procedures for customs clearance of goods, it is advisable to contact the competent Customs Offices of the country of destination.
5.4. Payment of the price must be made: - at the time of placing the Order, for advance payment by credit card of the Visa, Mastercard and American Express or PayPal circuits. The total amount due by the Customer is debited at the time the Order is sent. - upon delivery of the Products, for payment on delivery where indicated / possible. This payment can only be made in cash and only for Orders delivered in Italy. This payment method is not allowed for Orders containing Personalized Products and for Orders exceeding Euro 1,000.00. Cash on delivery has an additional shipping cost (rights received by the courier) which will be displayed in the Order cart. Until full payment has been received, the goods remain the property of Skuisito.
5.5. Skuisito uses a secure payment service that uses the PCI-DSS standard. Confidential credit card data (card number, holder, expiration date, security code) are encrypted and thus transmitted to the payment manager. Skuisito therefore never has access to and does not store the data of the credit card used by the Customer to pay for the Orders.
5.6. The billing request must be made at the same time as the Order. The business Customer who wants the invoice made out to the company relating to the Order, will be obliged to request the invoice in phase of data entry in the Order, by checking the appropriate box dedicated to the invoice for companies. The consumer customer who wants the invoice must request it from the Customer Service (using the online form or the telephone number) on the same day in which he places the order and receives the Order Confirmation email, indicating: Order number Email Name, Surname Full address Date, Municipality and Province of birth of the invoice holder Tax Code The document will be sent to the applicant in digital format by e-mail. Billing requests made in the days following the date of acceptance of the Order will not be accepted.
ART. 6 - UNAVAILABILITY OF PRODUCTS and FORCE MAJEURE
6.1. In the event that the Contract cannot be executed, even in part, due to unavailability of the goods or for other reasons of force majeure, Skuisito will notify the Customer via email within thirty days from the day of transmission of the order and will be released. from all its obligations, except for the reimbursement of any sums already paid by the latter.
ART. 7 - COPYRIGHT
7.1. The contract does not grant the Customer any rights to trademarks, logos and other distinctive signs of various kinds present on the Site, nor to the related contents. The contents of the site (texts, graphics, images and animations) are the property of Skuisito. All the content present or visible on the Site, including, but not limited to, logos, icons, registered trademarks, text, graphics, photographs, images (hereinafter "Content"), is the property of Skuisito and / or companies its content providers. It is not permitted to copy or transmit in any way portions or elements of the Site or its Content. The Site, its Content and all related rights remain the exclusive property of Skuisito. These rights are entirely reserved.
The Terms and Conditions for the use of the website www.skuisito.com apply to each visit and use of the Site. By accessing and using the Site, the Customer gives his consent to the "Terms and Conditions for the use of the site www.skuisito.com" in their entirety, as well as to any other law or regulation applicable to the Site and the internet.
ART. 8 - RIGHT OF WITHDRAWAL
8.1. Based on the provisions of Articles 52 and ss. Of the Consumer Code (Legislative Decree 206/2005 as amended by Legislative Decree 21/2014), the Consumer Customer has the right to withdraw from the contract, without penalties and without giving any reason, no later than 14 (fourteen ) days from receipt of the goods (or, in the case of multiple goods ordered through a single order and delivered separately, from the day on which the Customer or a third party designated by him, other than the carrier, acquires physical possession of the last good).

ART. 9 - LEGAL GUARANTEE OF CONFORMITY
9.1. In the event that the Customer identifies a lack of conformity of the Product, and is a consumer, the same has the right, at his choice, to request its replacement without charge, unless the requested remedy is impossible or excessively expensive compared to the other. . If replacement is not possible or is excessively burdensome, the Customer can request a reasonable reduction in the price or the termination of the contract and the reimbursement of a sum commensurate with the value of the asset, against the return of the defective Product. The termination of the contract is also excluded in the event of minor conformity defects.
9.2. Following the complaint, Skuisito will collect the product from the Customer within a reasonable time and, after checking the existence of the discrepancy, at the Customer's choice, replace the defective goods, without charge, unless the requested remedy is impossible or excessively burdensome compared to the other; or, if replacement is not possible, a reduction in the price or a refund of a sum commensurate with the value of the asset is not possible. However, Skuisito has the right to propose alternative remedies available, such as, by way of example, the replacement of the Product with another of a different nature but equivalent value, chosen from those displayed on the site, or the issue of a voucher of value corresponding to the amount paid, to be used later by contacting Customer Service. In the event that the Customer accepts, Skuisito will carry out the remedial service specifically proposed.
9.3. The legal guarantee lasts 2 (two) years from the delivery of the goods and must be enforced within 2 (two) months from the discovery of the defect: it is therefore necessary to report the lack of conformity as soon as possible and always keep the proof of purchase. The Customer can directly formulate the complaint in writing by post by registered letter with return receipt, at the addresses indicated in the Customer Service section of the Site.
9.4. Yes has a lack of conformity when:
- the asset is not suitable for the use for which goods of the same type are used;
- the good does not conform to the description given by the seller and does not possess the qualities described.
It is the Customer's responsibility to prove that the defect was already present at the time of delivery of the purchased Product.
We do not reimburse Products damaged due to improper use, or activities other than those for which they are intended, or negligence or expired.
ART. 10 - REQUESTS AND COMPLAINTS - ASSISTANCE
It is possible to request information, send communications or submit complaints by contacting the Skuisito Customer Service: - through the Site, by accessing the "Contacts" section of the Site; or - to the addresses indicated in the "Customer Service" section of the Site.
ART. 11 - PRIVACY
11.1. The data communicated by the Customer necessary for the execution of the contract are processed in compliance with the current legislation on the protection of personal data and in particular, in compliance with EU Regulation no. 2016/679, as well as the Legislative Decree. n. 196/2003 (Privacy Code) updated to Legislative Decree. n. 101/2018. The Customer's personal data are processed to allow the management of the Order, to deliver the Products, to provide assistance services and to manage payments. For this purpose, the data is transmitted to authorized service providers, appointed managers and / or persons in charge of data processing. Any use of data for other purposes is subject to the manifestation of specific express consent by the interested party. For more information, the Customer can consult the Privacy section of the Site. By placing an order, the Customer agrees and acknowledges that his data may be collected, used, stored and processed in accordance with the purposes stated in our Privacy Policy and on the basis of any freely expressed specific consents, which are requested in the cases and in the forms provided for by current legislation.
Therefore, if the Customer is a registered user on the website www.skuisito.com and has given his consent to the profiling activity, the purchase data may be associated with his profile / account whether the purchase is made by logging in or that it is carried out anonymously.
ART. 12 - AMENDMENTS TO THE TERMS AND CONDITIONS
12.1. Skuisito reserves the right to modify these General Conditions of Sale at any time. Any purchase contract between the Customer and Skuisito is subject to the version of the General Conditions of Sale in force at the time the Order is placed through the Site. The version is indicated with the date of the last revision, listed at the end of the Conditions. General.
ART. 13 - APPLICABLE LAW AND JURISDICTION
13.1. The parties, stipulating the contract pursuant to the previous art. 2, agree that it is governed by Italian law and subject to Italian jurisdiction, and that the application to it of the United Nations Convention on Contracts for the International Sale of Goods adopted in Vienna on 11/04/1980 is expressly excluded. This is without prejudice to the application to consumer customers who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided for by the law of the country in which they have their habitual residence.
13.2 The offer and sale of the Products on the Site, if the Customer is a consumer and is resident or domiciled in Italy, constitute a distance contract governed by Chapter I, Title III (articles 45 et seq.) Of the Consumer Code (Legislative Decree no. 206/2005 as amended by Legislative Decree 21/2014) and by Legislative Decree 9 April 2003, n. 70, containing the regulation of electronic commerce.
13.3. For any dispute concerning the validity, execution or interpretation of the contract and its effects, the following will be competent: a) the Court of the place of residence or domicile of the Customer, if the Customer is a consumer and is resident or domiciled in Italy; b) exclusively the Court of Caltanissetta, in any other case.
13.4. The consumer customer has the right to promote an out-of-court resolution of disputes relating to consumer relations through the use of the procedures referred to in Part V, Title II-bis of the Consumer Code (ADR - Alternative Dispute Resolution). With reference to the possible alternative dispute resolution tools, the Consumer Customer is informed that a European platform has been set up for the online resolution of consumer disputes (so-called ODR platform). The ODR platform is accessible at the following address http://ec.europa.eu/consumers/odr/. Through the ODR platform, the consumer customer can consult the list of ADR bodies, find the link to the site of each of them and start an online resolution procedure for the dispute in which he is involved.
13.5. The rights are reserved in any case of Consumer Customers to refer the matter to the competent ordinary court for the dispute arising from these General Conditions of Sale or the Contract, whatever the outcome of the out-of-court settlement procedure.
